The federal baseline for overtime

Under the U.S. Fair Labor Standards Act, most hourly (non-exempt) employees are entitled to at least 1.5ร— their regular rate for hours worked beyond 40 in a single workweek. Some states set stricter rules โ€” for example, daily overtime after 8 hours in a day, regardless of the weekly total โ€” and some employers voluntarily offer double time for holidays or very long shifts.

Worked example

At $22/hour with 40 regular hours and 6 overtime hours at time-and-a-half: regular pay is $880, overtime pay is 6 ร— $22 ร— 1.5 = $198, for a weekly total of $1,078 โ€” or about $56,056/year if that schedule held every week (before taxes).

Why the annual figure is a rough estimate

Real paychecks vary week to week with overtime, unpaid time off, holidays, and taxes/deductions all affecting take-home pay. Treat the annual projection here as a ceiling estimate based on a consistent schedule, not a guaranteed number.

Frequently asked questions

Does this apply to salaried employees?

Only non-exempt salaried employees are typically entitled to overtime under federal law; many salaried professional, administrative, and executive roles are classified as exempt and don't receive overtime pay regardless of hours worked.

Is overtime taxed at a higher rate?

No โ€” overtime pay is taxed the same as regular wages. It can push more of your income into a higher withholding bracket for that specific paycheck, which sometimes makes it look like it's taxed more, but your effective annual tax rate is based on total yearly income, not which paycheck the money came from.

What if my state requires daily overtime?

This calculator uses the standard weekly-40-hours federal rule. If your state requires overtime after a certain number of hours in a single day (a few states do), your actual overtime pay could be higher than this estimate.
